The excavator operator killed Dec. 28 after his machine flipped over was the owner of Marc Lafreniere Construction Inc., said a spokesperson for the Ministry of Labour today.

The 51-year-old had been operating the machine in a swampy area on a bush trail north of Dominion Drive in Valley East when the accident occurred.

The victim was located by a fellow employee, who notified emergency services at around 3:30 p.m.

Emergency service personnel extricated the man, but were unable to revive him, and he was pronounced dead at the scene.

His name has not been released by Greater Sudbury Police. Labour Ministry spokesperson Bruce Skeaff said he's also unable to release the victim's name because of privacy legislation.

A Ministry of Labour investigator visited the scene and will be writing a report about the incident, Skeaff said. He said he's not sure how long it will take before this report is completed.

However, if the ministry decides to lay charges under the Occupational Health and Safety Act, by law, it must do so within a year of the accident, Skeaff said.
