Second warrant issued for baby's mother

An arrest warrant for 21-year-old Christopher Smith, who is facing charges in the death of his three-month-old son, has been issued after just two days after he was released on bail.

Smith was arrested on Feb. 13, after paramedics contacted police after taking Smith's son, Bryce, to St. Joseph's Health Centre. Bryce was airlifted to an Ottawa hospital, and died five days later.

A warrant has also been issued for 20-year-old Angele Bertrand, Bryce's mother, said Greater Sudbury Police const. Bert Lapalme.

Smith is facing four charges, one each of manslaughter, criminal negligence causing death, failing to provide the necessities of life, and assault (against Smith's common-law wife).

According to media reports, Smith's first attempt at bail was denied, but the second was allowed, so he could receive alcohol addiction counselling.

Three people posted $2,500 each as surety for Smith, and he was released with the condition that he must follow a curfew that would have him with one of the three sureties between 11 p.m. and 6 a.m. The bail conditions also required Smith to not be in contact with Bertrand.

Only four days after being released on bail, information provided to the police indicated he was not following the conditions set out in his bail.

The police went to the address where Smith lived, and found he was not there. Information has led police to believe he left in the company of Bertrand.

Smith is wanted on three counts of breach of recognizance, and Bertrand is wanted on a charge of party to the offence of breach of recognizance.

  • When all the actaual facts of this case are heard through the courts and the public is informed about all that actually happened and how it all went down, then there will be alot of people on hear with a little (alot) egg on their faces....Inocent until proven guilty? Not on here!

  • With Held, how was your safety at risk if the police didn't tell the media that he was wanted? Is it possible that some one had to check to make sure they were breaching first? whats a right to safety? Wasn't it a judge that released him in the first place.

  • 99gt, I question his release as well but I know for a fact that they were looking for both Christopher and Angele long before they notified the media and for that I have serious issues.. As far as I know the media was not notified by the Police or the Children's Aid they were notified by the public.

    If his sureties had concerns over the weekend, the police and the Children's Aid had concerns about their disappearance and his breach than we had a right to safety by being informed.

    What does it matter. He was granted bail on Fri. Maybe he didn't breach his terms until Sunday or Monday.

    What we should really be looking at is the Superior Court judge who overturned the Justice of the Peace ruling to grant him bail. This is border line negligent.

    Maybe somebody could confirm but i thought people who were up for murder or man slaughter are not SUPPOSED to be eligible for bail?

  • It took the Greater Sudbury Police and Children's Aid who were both aware of the situation days to report it to the public. Why are we not important enough to know?

  • This case perfectly illustrates the faults in our justice system. Way too much leniency.
    A lesson learned for the crazy people who put up this joker's bail.
    And as for the woman fleeing with the murderer of their child...if she left willingly with him, she's the type that makes me no longer supportive of abused women.
    They have one twisted relationship, those two.

  • This clown has how many years of schooling. His lawyer and the judge have how many. Yet who is the smartest?? I believe months ago his lawyer was complaining about him being in solitary confinement and how hard it was on him. Now that he's got bail these two should be held accountable should anything happen. Someone mentioned death threats. (Are you serious or just kidding.) I guess by giving this idiot and many others bail which they don't follow just allows the lawyers /judges to maintain their employment.

  • Whoever is responsible for letting this guy out on bail is not very smart at all.He never should have been out on bail.I certainly hope that the police catch him and throw him in jail and not let him out on bail again.

    my2pennies, I dont have any sympathy for those who posted his bail. I have been in situations in the past that required me to post someones bail. To do this you must stand before the judge and all conditions and requirements in the bail are laid out plain and simple in front of you and the courts. You have to swear in front of a judge that you agree to these conditions and will assure that the bailee will abide by these conditions while in your custody.
    One of those conditions was a non-communication order between chris and angele. they were put there for a reason and if you swore to the courts that this would'nt happen, then you put yourself in the position to loose money. The bail was split among three people if I'm not mistaken and it was $2500 each. He had someone out there (3) who was willing to pay $2500 for his freedom. And thats what they did, no sympathy from me. If they are looking for sympathy, it's in the dictionary between sh*t and syphilis.

  • Murderers, rapists and generally violent criminals who are released on bail should have both their legs broken before they get to leave custody....to help make sure they don't go anywhere.

  • I heard about this at 1pm yesterday afternoon.
    The police in this city have photos of both chris and angele. Why did they not ask the publics help yesterday at noon. Why wait until today to let people know. I always see "police seek publics assistance in finding". The public is out there and stand a better chance of spotting these two than the police (unless the two stop for coffee at tims) so why were we not told of this yesterday? I did attempt to post comments on the star yesterday about this and none of my posts would show.

    I have heard that he was getting alot of death threats, if this is just a way for the police to hide him and keep him safe, why the mother too? They both definitely look guilty now!

  • The baby Bryce facebook page is saying was saying last night that both Chris and the mother Angel are on the run.
    I feel bad for those who were responsible for him..what happens to them?

    What better alcohol addiction counselling than isolation in a jail cell? Now he gets to go on a bender until the cops find him. When he's caught he'll say he fled because he felt his life was in danger due to the media attention of the case. And the sympathetic judge will show leniency once again. What a country we live in!

    our judges certainly do not seem to take a dim view on crimes against babies, as we have seen over time... once again, our judges want to protect the criminals, not the victims...

  • Bail was denied by a justice of the peace on Feb 22.

    Reviewed again by Superior Court Justice John Poupore over ruled that ruling and released him this past week. Way to go Mr Poupore. Your lack of judgement should cost you your job and warrant your own arrest.

  • So the police do the hard work of catching the fella and having him charged, bringign him before the courts and the judge lets him out for treatment and/or because his lawyer gives some sort of sob story how he's in isolation/life is being threatened. Have we forgotten about how the lives of the victim, his siblings, and his mother were threatened? So now there's an abusive, alcoholic, baby killer out on the streets and the police are having to use more of their resources to capture him again. Brilliant move.

  • Really what surprise!! a scumbag accused of manslaughter flees before he can go to trial, what next bail for kidnappers?oh wait I forgot they've been there and done that already!!Maybe this time they'll learn to be less sympathetic to the scum that do these crimes and think about the public at large for a change.
